The present criminal writ petition has been filed under Article 226/227 of the Constitution of India seeking a writ in the nature of habeas corpus for release of the detenue namely Chahatpreet Singh son of Achhara Singh from the illegal custody of respondent No.3 who has been picked up on 10.07.2026 and to produce him before this Court and further to appoint a warrant officer to get release the detenue from illegal custody of respondent No.3. 2. Report of the Warrant Officer has been received, which is taken on record. 3. As per the report, Warrant Officer visited the premises of CIA Staff, Khanna in the presence of the petitioner and her husband and found the alleged detenue, Chahatpreet Singh @ Prince, lodged in the lock-up. The detenue alleged that he had been illegally picked up from Mohali by ASI Parmod Kumar and his police party and subjected to physical assault while in police custody and pointed out certain visible POONAM 2026.07.17 18:18 I attest to the accuracy and integrity of this document CRWP-8270-2026 (O&M) 2 injuries on his body. The police officials, however, informed that the detenue had been legally arrested in FIR No.0174 dated 06.07.2026 under the Arms Act and the BNS and had been medically examined after arrest. The police denied the allegations of custodial torture and stated that the injuries were sustained during an attempt by the detenue to escape from custody. As per record of FIR and other papers, detenue- Chahatpreet Singh was legally apprehended by the police and no further action is required to be taken in this petition. 4. In view of this, the instant petition stands disposed of. 5. Pending miscellaneous applications, if any, are also disposed of.
