JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before the Court seeking quashment of a proceeding in C.C.No.3306/2013 registered for the offences punishable under Sections 406 and 420 read with Section 34 of the IPC. 2. Heard Sri. Yashavanthswamy A.M., learned counsel appearing for the petitioner, Smt. Waheeda M.M., learned HCGP appearing for respondent No.1 and have perused the material on record. 3. The petitioner is said to be accused No.1, who has not appeared before the Court at all and not cooperated with conclusion of the proceedings for the last 13 years. Therefore, the proclamation is issued against the petitioner. 4. Learned counsel appearing for the petitioner while seeking quashment of the entire proceedings submits that the procedure that is to be followed under Sections 82 and 83 of - 4 - HC-KAR CNR: KAHC010430792026 NC: 2026:KHC:39160 CRL.P No. 9126 of 2026 the Cr.P.C. are given a go-by while issuing the order of proclamation. In that light, the learned counsel seeks quashment of the entire proceedings. 5. Since the petitioner has not appeared before the concerned Court for the last 6 years, the proclamation has been issued. No fault can be found with the said act of the concerned Court. 6. However, showing indulgence on a condition that the petitioner would appear before the concerned Court on 13.08.2026, i.e., the next date of listing, the said proclamation stands suspended. 7. In the event the petitioner would not appear before the concerned Court on the said date, the proclamation would swing back to action and the concerned Court is at liberty to pass necessary orders in accordance with law. 8. Since the issue is of the year 2013, I deem it appropriate to direct the concerned Court to conclude the proceedings within an outer limit of six (6) months from the date of receipt of the copy of this order.
