The petitioner who is the brother of detenu-Mukhesh Seni @ Mukhesh Mali (CTP No.00518) is before this Court seeking for the following reliefs: a. Issue a writ of certiorari or any other appropriate writ, order or direction quashing the impugned parole extension rejection bearing No. DGPCSB/JDCL/SEC4/127/2026-JUDCL dated 25.05.2026 produced as ANNEXURE-'E', issued by the Respondent No.2/Director General of Police, Prisons and Correctional Services; b. Issue a writ of mandamus or any other appropriate writ, order or direction directing the Respondent Authorities to grant extension of general parole to Convict Prisoner No.00518, Sri Mukesh Seni Mukesh Mali S/o Bhagwan Singh Mali, presently lodged in Central Prison, Shivamogga, for a period of 60 days for the purpose of attending to and making necessary arrangements for the higher medical treatment of his aged father, who is suffering from serious ailments and requires continuous care and assistance; - 3 - HC-KAR CNR: KAHC010449322026 NC: 2026:KHC:38526 WP No. 20354 of 2026 c. Pass such other order or direction as this Hon'ble Court deems fit in the interest of justice and equity. 2. The detenu had been convicted in Spl.C.No.59/2016 for offences under Section 366A, 376D, 201, 506 r/w 34 of IPC and 5(g) r/w 6 of POCSO Act by the Prl. District and Sessions Judge, Udupi and sentenced on 26.11.2019 with the highest of the sentence being imprisonment for 20 years. The detenu has served a period of 9 years 6 months 22 days of imprisonment as on 03.06.2026 and his conduct in jail is said to be satisfactory. The petitioner having made an application for parole, the same came to be rejected on account of adverse report having received by the police. 3. Learned counsel for the petitioner submits that the detenu was granted parole by the prison authorities on 22.04.2026 for a period of 30 days on account of the medical treatment of the detenu's father. He further submits that the treatment is still continuing, thereby necessitating the continued presence of the detenu to attend to and assist his father during the course of such treatment. 4. It is further submits that during the aforesaid period of parole, the detenu strictly complied with all the conditions imposed by the prison authorities and - 4 - HC-KAR CNR: KAHC010449322026 NC: 2026:KHC:38526 WP No. 20354 of 2026 surrendered before the jail authorities upon the expiry of the parole period without any complaint or violation. 5. In that view of the matter, taking into consideration the conduct of the detenu has been satisfactory, there is no particular complaint against the detenu, I pass the following: ORDER i. The Writ Petition is allowed. ii. Respondent–the Chief Superintendent, Central Prison, Shivamogga is directed to release the detenu- Mukhesh Seni @ Mukhesh Mali (CTP No.00518) on parole for a further period of 30 days commencing from 03.08.2026, subject to the following conditions: a) The detenu shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the detenu would evade going back to the gaol, after the expiry of the period of parole. - 5 - HC-KAR CNR: KAHC010449322026 NC: 2026:KHC:38526 WP No. 20354 of 2026 b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii. The Registry is directed to communicate the order to the prison authority for its immediate execution. iv.
