29/07/2026 D/L – 68 Court No.35 S. Kundu Rejected C.R.M.(NDPS) 1477 of 2026
In Re: An application for bail under Section 483 of the BNSS, 2023. In connection with English Bazar P.S Case no. 1857 of 2025 dated 23/08/2025 under sections 21(c)/27A/29 of the NDPS Act. In the matter of: Mahibur Sk & Anr. …Petitioners. Mr. Abhimanyu Banerjee Mr. Arnab Saha Mr. Abdul Nooman …for the petitioners. Mr. Shataroop Purkayastha …for the State.
Learned advocate appearing for the petitioners submits that the petitioners are in custody for 363 days and the subject matter of recovery in the present case is 814 gms of brown sugar. Charge sheet has already been submitted but there is no possibility of the trial commencing, as such the petitioner prays for bail. Learned advocate for the State opposes the prayer for bail. It has been pointed out by the State that the other accused persons are absconding. In view of the aforesaid, the learned trial court would exhaust the process of law, split up the trial and overcome the stage of consideration of charges at the earliest within a period of three months from the date of consideration of
2
charges. The learned trial court would complete the seizure list witnesses on priority basis. The petitioners would renew their prayer for bail after the aforesaid witnesses are completed before the learned trial court. With the aforesaid observations, CRM (NDPS) 1477 of 2026 is dismissed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
