Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than two years. Similarly placed accused person has been granted bail by the Hon’ble Apex Court in SLP (Criminal) No. 10561 of 2026. Till date, the prosecution has examined one witness out of 39 witnesses cited. Learned advocate appearing for the State opposes the prayer for bail but he is unable to distinguish the locus of the present petitioner with that of the Bapan Halder, who has been granted bail by the Hon’ble Apex Court. Having regard to the observations of the Hon’ble Apex Court and bail has been granted on grounds of less possibility of trial being completed within a logical period of

time, I am of the view that the petitioner be extended the same benefit. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Nadia without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1469 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
