(2) Petitioner was engaged as Junior Engineer in 2022. In the year 2024, certain irregularities were found in the construction work, which was supervised by the petitioner. Consequently, petitioner was slapped with the recovery order dated 3.7.2025, which was challenged by her in Writ Petition (M/S) No. 2373 of 2025, in which this Court granted interim order in favour of the petitioner, staying the effect of the recovery order. Now, petitioner has filed this writ petition seeking the following reliefs:
“a) Issue a writ, order, or direction in the nature of certiorari, quashing the impugned
order dated 09.09.2024 passed by Respondent No. 1 (As Annexure A.1), whereby the Petitioner was relieved from the post of Junior Engineer and repatriated to her parent organisation, UPNL;
b) Issue a writ, order, or direction quashing the letter dated 18.09.2024 issued by Respondent No. 3 (As Annexure A.2), whereby the District Panchayat Raj Officer forwarded the Director’s instructions and confirmed initiation of recovery proceedings against the Petitioner;
c) Issue a writ, order, or direction commanding the Respondents to restore the Petitioner to her position with all consequential service benefits;”
(3) Learned State Counsel submits that the irregularities, allegedly committed by the petitioner, led to passing of recovery
order against her and petitioner’s relieving
2026:UHC:2131 from charge of Junior Engineer is also on account of those irregularities. He, therefore, submits that petitioner should have sought the relief, as has been sought here, in her earlier writ petition. Learned Counsel thus submits that this writ petition would be barred by principle of constructive res judicata.

Learned Counsel for the petitioner then seeks leave to withdraw this writ petition with liberty to move appropriate application in the pending writ petition.

learned Counsel for the petitioner, writ petition is dismissed as withdrawn with liberty to file appropriate application in the pending writ petition.
