The petitioner alleges that some hooligans and unknown elements had forcefully entered into the office of the Co-operative Society and tried to take over the management and control of the said society by ousting the petitioners who claim to be the elected board of directors. The petitioners have raised a dispute under Section 102 of the West Bengal Co-operative Societies Act, 2006. 2. The writ petition is disposed of with a direction upon the Assistant Registrar of Co-operative Societies, Cooch Behar, i.e, the respondent no.6 to treat the writ petition as a dispute in terms of Section 102 of the West Bengal Co-operative Societies Act, 2006 and proceed in accordance with law as contemplated under the said Act. 2 3. Needles to mention that, all the parties shall be heard and the dispute shall be disposed of in the manner prescribed under the relevant law. 4. The entire exercise shall be completed within a period of 12 weeks from the date of communication of this order and a decision shall be passed which shall be communicated to the parties. 5. Prima facie, upon perusal of the report filed by the Deputy Registrar it appears that the individuals against whom the petitioner has lodged complaints were elected as office bearer pursuant to an election process. 6. Thus the question of granting any interim order at this stage does not arise. 7. There shall be no order as to costs. 8. Parties are directed to act on the basis of the server copy of this order.
