28.07.2026 Item No.35 Ct. No. 05 PG W.P.A. 17236 of 2026 Serina Bibi Vs. The State of West Bengal & Ors. Mr. Sufi Kamal, Adv. Mr. Shireen Hossain, Adv. …..For the Petitioner Mr. Barun Ghosh, Adv. Mr. Amit Dey, Adv. ..For the State 1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. From the case made out in this writ petition, it appears that right of the petitioner to ingress and egress is being impacted by the private respondent prompting the petitioner to approach this Court with the present writ petition seeking direction upon the concerned police authority to take certain steps, which would facilitate the petitioner to use pathway. 3. State respondents are represented by learned advocate, who has submitted that issue involved in this writ petition is civil in nature. 4. Having considered the submissions made on behalf of the parties and case made out in this writ petition, it appears that petitioner is aggrieved by denial of her right to ingress and egress. 5. If petitioner’s right to ingress and egress is denied, in that event, petitioner needs to approach civil forum in pursuit of remedy. Police authority is not 2 the appropriate authority to decide the right of the petitioner to ingress and egress. 6. Hence, present writ petition is not interfered with and the same stands dismissed. 7. However, this order shall not preclude the petitioner to approach appropriate forum, if so advised. 8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
