1. This writ petition under Article 226 of the Constitution of India has been preferred by the petitioner against the impugned order dated 17/07/2020 (Annexure P/1) passed by respondent No. 3 by which petitioner’s claim for grant of compassionate appointment has been rejected.
2. Learned counsel for the petitioner submits that the impugned
order is unsustainable and bad in law and therefore, it is liable to be set aside.
3. Learned counsel for the respondents would support the impugned
order and submit that this writ petition is liable to be dismissed.
4. I have heard learned counsel for the parties and perused the record.
5. Admittedly, petitioner’s father late Nanjat Netam died in harness on 31/12/2015. Thereafter, petitioner filed application for compassionate appointment on 24/11/2017, however, her application was rejected by the respondents by order dated 22/02/2018 stating that since the petitioner is a minor, her application is being rejected, however, she has the liberty to
3 reapply when she attains the age of majority. Thereafter, petitioner became major on 01/08/2019 and she moved application for grant of compassionate appointment on 28/08/2019, however, it has been rejected by impugned order dated 17/07/2020 on the ground of delay stating that as per policy dated 20/07/2013, the application for grant of compassionate appointment has to be filed within three years from the date of death of the government employee. Though it is the contention of learned counsel for the petitioner that respondents themselves have stated by order dated 22/02/2018 that petitioner can file application after attaining the age of majority, which she has filed, but it is contrary to the policy dated 20/07/2013 wherein three years limitation has been prescribed for making an application for compassionate appointment. Moreover, it has been 10 years since the death of petitioner’s father and now it would not be appropriate to direct the respondents to grant compassionate appointment. As such, I do not find any merit in this writ petition.
6. Accordingly, this writ petition is hereby dismissed leaving the parties to bear their own cost(s). Sd/-
