Heard the parties. The petitioner has moved this Court for grant of bail in connection with Adityapur P.S. Case No.353 of 2024 (S) (N.D.P.S. Case No. 43 of 2025) registered for the offences punishable under sections 17(b)/21(b)/27A of N.D.P.S. Act. Learned Spl. P.P. files the counter affidavit. Keep the same in the record. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in selling of brown sugar and 5.45 grams of brown sugar was recovered from the co-accused who said that she has purchased the brown sugar from the petitioner. It is further submitted that the allegations against the petitioner are all false and the brown sugar comes under intermediate quantity. It is then submitted that the petitioner has been in custody since 16.10.2025, as has been mentioned in paragraph no. 20 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the co-accused persons with similar allegation have already been admitted to bail by a coordinate Bench of this Court vide orders dated 25.11.2024 and 07.12.2024 in
B.A. Nos.9726 and 10240 of 2024 respectively. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl. P.P. opposes the prayer for bail and submits that the petitioner is involved in two cases apart from this case but the offences involved in the said cases have not been mentioned in the counter affidavit. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.S.J.-I, Seraikella, in connection with Adityapur P.S. Case No.353 of 2024 (S) (N.D.P.S. Case No. 43 of 2025)with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
