Mr. Rajendra Banerjee Mr. Suman Chakraborty. …for the State. Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Suman Chakraborty, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 5 months, charge-sheet has already been submitted and there has been no seizure from the present petitioner. Learned advocate for the State opposes the prayer for bail and submits that the seizure in this case is 298 grams of brown sugar which was from a different accused. So far as the present petitioner is concerned, there has been no recovery from him and he 2 has been implicated on the basis of available oral evidences. Having regard to the period of detention of the present petitioner and his complicity and the fact that 11 witnesses have been relied upon by the prosecution, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Md Nawaj Sarif @ Pappu shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1017 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
