JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.2152/2025, pending before the Prl. Civil Judge and JMFC, Mysuru, for the offences under 114, 395, 504, 506, 507 of Indian Penal Code. - 3 - HC-KAR NC: 2026:KHC:20124 CRL.P No. 11604 of 2025 2. Heard Sri.Afroz Pasha, learned counsel appearing for the petitioner, Sri.Anoop Kumar, learned HCGP appearing for respondent No.1, Sri.Rajesh S.R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “We Tabreez Pasha @ Setu S/o Late Afsar Pasha, aged about 32 years Residing at No: 56, 2nd floor, 4th A cross Ilyaz nagar JC Nagar Bangalore- 560078 and JABEER BAIG S/o Late Muneer Beig Aged about 43 years Residing at: No 139, 6th Cross, Abdul Rehmaniya Road Udayagiri Mysore- 570019 do hereby solemnly affirm and state on oath as follows: 1. I Tabreez Pasha @ Setu, accused/petitioner in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit. 2. I JABEER BAIG, I am the complainant in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit. 3. We submit that, we have filed an application u/s 359 (2) OF BNSS to compound the offences in the above criminal petition. 4. I complainant submit that, my main dispute was with the accused no 1 to 4 is already been solved and I have not dispute with the present petitioner and I am willing - 4 - HC-KAR NC: 2026:KHC:20124 CRL.P No. 11604 of 2025 to proceed with the present case against the present petitioner. 5. That, we both complainant and petitioner have no other claims against each other. 6. That we both have settled our disputes and matter has been compromised between us in the presence of the well-wisher. 7. That the above offences are compoundable with the permission of this Hon'ble court. 8. That, this Hon'ble court have jurisdiction u/s 528 of BNSS to quash the entire FIR basis settlement between the parties. 9. We submit that, we have settled our disputes with own will and wish without any influence or force. What is stated above is true and correct to the best of my knowledge, information and belief. wherefore it is most respectfully prayed that this Hon'ble may please to: A. Allow application filed u/s 359(2) of BNSS and permit the parties compound the offences. B. Pleased to entire quash the entire CC No 2152/2025 (Cr No 25/2024) for the offence's 114, 395, 504, 506, 504 of IPC registered and charged sheeted by the respondent police I;e Mandi Police station, pending on the file of the Hon'ble Prl Civil Judge & JMFC Mysuru in the interest of justice and equity.” 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.2152/2025 pending before the Prl.
