In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Nanoor P.S case no. 149 of 2025 dated 08/08/2025 under Sections 85/80(2)/108/3(5) of the BNS and 4 of the Dowry Prohibition Act. In the matter of: Sekh Hafijul @ Sekh Hapi ...Petitioner. Mr. Raju Mondal …for the petitioner. Mr. Krishnendu Bhattacharyya Ms. Tanushree Kar …for the State.
Learned advocate for the petitioner submits that the petitioner is the maternal uncle-in-law, who has been falsely implicated in this case. Learned advocate for the State opposes the prayer for anticipatory bail and submits that the complicity of the petitioner would be available from all the statements which are appearing. Although the case is under Section 108 of the BNS. Learned Additional Public Prosecutor refers to the post-mortem report and emphasize regarding the nature of injury which was inflicted upon the deceased. I have taken into account the nature of injury which are appearing on person of the deceased. I have also taken into account regarding the locality where the present petitioner stays. The petitioner is staying within the same

boundary, although it has been claimed that the hearth is different. Having regard to the fact that this is an application for anticipatory bail, I am of the view that the parameters set in law do not favour the petitioner with the prayer advanced for. Accordingly, the prayer for anticipatory bail of the petitioner in CRM (A) 901 of 2026 is dismissed. Mr. Bhattcharyya appears on behalf of the State, who is the learned Additional Public Prosecutor of the State. His appearance be regularized by the concerned authorities.
