The Applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.600/2026, registered at Police Station – Sakri, District Bilaspur (C.G.) for alleged commission of offences punishable under Sections 296, 351(3), 119(1) and 3(5) of BNS.

2 Court below], complainant Vinod appeared at the police station and lodged a report stating that on the date of the incident, while he was proceeding from his house towards Bahatrai on his motorcycle, at about 7:35 p.m., when he reached in front of the house of Bhagela Sahu, he found three persons standing there. They signalled him to stop and when he stopped, abused him in filthy language and demanded money for consuming liquor. Upon his refusal to give them money, the three persons allegedly threatened to kill him and assaulted him with a Bagranda stick. At that time, Titra Shrivas, a resident of the same village, was returning towards the village from the direction of Bahatrai. The complainant stopped him and narrated the incident. Upon seeing the said persons, Titra allegedly identified one of them as Badku Yadav and stated that another was the son of Tirith Dahait. Thereafter, the three persons attempted to flee, but the complainant apprehended Badku Yadav, while the other two persons escaped. Based on these allegations, the present FIR was registered against the Applicant for the offences punishable under the aforementioned Sections. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present
3 case. It is submitted that the name of the Applicant has surfaced in the memorandum statement of the co-accused. It is further submitted that there is no specific overt act attributed to the Applicant and trial is likely to take considerable time for its conclusion, therefore, he may be granted the benefit of anticipatory bail.

On the other hand, learned State Counsel opposes the application and submits that as per the prosecution case, the complainant was stopped by three persons, who demanded money from him for consuming alcohol and upon his refusal, assaulted him with a stick. It is further submitted that two of the accused persons have been named in the FIR, whereas the name of the present Applicant has subsequently surfaced in the memorandum statement of the co-accused. It is further submitted that the Applicant, along with the said co- accused, was involved in the incident and therefore, he does not deserve the benefit of anticipatory bail.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the allegation that the complainant was
4 stopped by three persons, who demanded money from him for consuming alcohol and upon his refusal, assaulted him with a stick and the fact that the name of the present Applicant has surfaced during investigation in the memorandum statement of the co-accused, indicating his involvement in the incident, investigation is going on and without further commenting anything on the merits of the case, this Court is not inclined to extend the benefit of anticipatory bail to the Applicant.

Accordingly, the Anticipatory Bail application of the Applicant – Yashwant @ Aswant, filed under Section 482 of the BNSS, 2023 in connection with Crime No.600/2026, registered at Police Station – Sakri, District Bilaspur (C.G.) for alleged commission of offences punishable under Sections 296, 351(3), 119(1) and 3(5) of BNS is hereby rejected.
