13 jdt. 23.07.2026 jb. WPA 17976 of 2026 (Hera Bibi vs. State of West Bengal & Ors.) Rabiul Islam Ms. Rama Halder Mr. S. K. Santra Mr. Tapan Kr. Mondal …. For the Petitioner Mr. N. Roy Mr. Madhu Jana Mr. Vinayak Choubey …. For the State Sarwar Jahan Mr. Sayantan Hazra Ms. Shalini Sen Sahina Parvin …. For the Private Respondents Though the date of listing of the application has been stated as 27th July, 2026, both the parties are present in Court. By consent of the parties, the matter is taken up for consideration. The petitioner who is the Pradhan of Sahabanchak Gram Panchayat assails the no confidence motion submitted by the private respondents/members of the Panchayat on 15th July, 2026 and the notice issued by the Prescribed Authority on 17th July, 2026 solely on the ground that copy of the motion was not sent to her at her residence. Learned counsel for the private respondents produces postal receipt as well as track report which clearly indicate that the notice of motion was not only sent to the petitioner at her residential address but was also received by her thereat. 2 In view of the above, this Court is inclined to hold that the writ petition is devoid of any merit and is accordingly dismissed. Since the meeting has been fixed on 27th July, 2026, the Inspector in Charge, Baisnabnagar Police Station is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully without any disturbance from any corner whatsoever. Copy of the order be communicated to the Officer in Charge, Baisnabnagar Police Station by the parties at the earliest. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
