Bose B. Garden Police Station case no. 139 of 2025 dated 14.07.2025 under Sections 103/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Dipak Chowdhury. ……Petitioner. Mr. Soumya Basu Roy Chowdhuri Mr. Abir Dolui .....for the Petitioner. Ms. Surabhi Banerjee ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than a year and till date only case has been committed to the Court of Sessions. Prosecution has relied upon 23 witnesses in the charge-sheet, there is no possibility of the trial being taken to its logical conclusion in future, as such petitioner may be released on bail. Learned advocate appearing for the State on the other hand opposes the prayer for bail and refers to the statement of the witnesses who has named the present petitioner. I have taken into account the said statement and without commenting on the merits of the case, at this stage, I am not inclined to release the petitioner in bail. Accordingly, CRM (M) 1565 of 2026 is dismissed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
