Heard Mr. Amit Kumar Jaiswal, learned counsel for the petitioners. Also heard Mr. Jitendra Shrivastava, learned Government Advocate for respondent No.1 / State. 2. The present writ petition has been filed by the petitioners with the following prayers: “1. Allow the present application and condone the delay for some extra days in depositing the cost amount of Rs. 5,000/-. 2. Grant an extension to deposit the said amount of Rs. 5,000/- in the Registry of this Hon'ble Court pursuant to the order dated 16.07.2026; and/or 3. Pass any other order or directions that this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.” 3. Learned counsel for the petitioners submits that vide order dated 16.07.2026 passed by this Court in CRMP No. 1843/2026, the earlier petition was dismissed as withdrawn with liberty to file a fresh petition after incorporating the necessary pleadings and annexing the relevant documents, subject to deposit of costs of Rs.5,000/- in the Registry of 3 this Court within one week, i.e., on or before 23.07.2026. It is submitted that the petitioners could not deposit the said amount within the stipulated period on account of bona fide and unintentional circumstances beyond their control, as the learned counsel for the petitioners remained occupied in another matter and could not deposit the amount in the Registry within time. It is further submitted that there was never any intention to disobey the order of this Court, which the petitioners hold in the highest regard. It is lastly submitted that no prejudice would be caused to the respondents if the delay in depositing the costs is condoned and the time for deposit is extended, whereas the petitioners would suffer irreparable prejudice as the certified copies of the documents are required for filing the fresh petition in terms of the liberty granted by this Court. 4. Learned State counsel on the other hand has not objection if the prayer made by the petitioners for extension of time to deposit the cost amount is allowed. 5. We have heard learned counsel for the parties and perused the documents appended with the petition. 6. Considering the submissions made by learned counsel for the parties and there being no objection on behalf of the State, this Court finds it appropriate to allow the present petition. Accordingly, the petitioners are granted one week’s further time from today to deposit the cost of Rs.5,000/- in the Registry of this Court. In the event the aforesaid amount is not deposited within the stipulated period, this 4 petition shall stand dismissed automatically without further reference to the Court. 7.
