1. The petitioner has filed this petition seeking the following relief(s):-
“1. That, the Hon'ble Court may kindly be pleased to direct the respondent no. 1 to act on the recommendation of respondent no. 2 dated 07.07.2021 (Annexure P/10), in the interest of justice. II. That, the Hon'ble Court may kindly be pleased to NIRMALA RAO
2 direct the respondent no. 1 to sent the proposal to respondent no. 3 as asked vide the letter dated 08.08.2022 (Annexure P/12). III. That, this Hon'ble Court may kindly be pleased to direct the respondent no. 1 to carry on the amendment in pay grade of Personal Assistant Chhattisgarh Public Works Department (Non-Gazatted) Service Rules, 2016 (Annexure P/5): IV. That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to revise the promotion
order of the petitioner dated 14.10.2020 (Annexure P/2) stating that the petitioner will be paid salary of Level 9. V. That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to pay arrears of salary which has been wrongly fixed at Level 8 instead of Level 9 from the date of his promotion i.e 14.10.2020. VI. Any other relief, which this Hon'ble Court deems, fit in the facts and circumstances may also be granted in favour of the petitioner.”

Learned counsel appearing for the petitioner would submit that the petitioner was appointed to the substantive post of Stenographer vide
order dated 3.9.2014 under the respondents in the Public Works Department. He was promoted to the post of Personal Assistant vide
order dated 14.10.2020 in the pay matrix of Rs. 35,400–1,12,400 at Level-8. She would submit that the pay scale of government servants was revised in the year 2008 vide order dated 22.7.2011, whereby the pay scale of Personal Assistants in the Government departments was fixed at Rs. 9,300–34,800 with Grade Pay of Rs. 4,300, payable with effect from 1.1.2006. She would contend that, due to a mistake, the Grade Pay of Rs. 4,200 was granted instead of Rs. 4,300, and therefore, representations were submitted by the petitioner before the
3 respondent authorities. She would further submit that the Chief Engineer, Public Works Department, addressed a letter to the Secretary of the Department seeking rectification of the said mistake. Subsequently, respondent No. 3 sent a letter to the Secretary, Public Works Department, requesting that the necessary amendment be carried out in the service rules particularly in Schedule-I of the Chhattisgarh Public Works Department (Non-Gazetted) Service Recruitment Rules, 2016. She would contend that a direction may be issued to respondent No. 1 to take a decision on the communication dated 8.8.2022 (Annexure-P/11) within a stipulated time.
3. On the other hand, learned counsel appearing for the State would oppose the submissions made by learned counsel for the petitioner.
4. I have heard learned counsel for the parties and perused the documents available on record.

Having considered the limited prayer made by learned counsel for the petitioner, this petition is disposed of with a direction to respondent No. 1 to take an appropriate decision on the communication dated 8.8.2022 issued by the General Administration Department, State of Chhattisgarh, within a period of 120 days from the date of receipt of a copy of this order. The petitioner shall be at liberty to submit a detailed representation along with a copy of this order and the communication dated 8.8.2022 before respondent No. 1.
6. With the aforesaid observation(s), this writ petition is disposed of.
