Order on Board 06/08/2026
1. The present writ petition has been filed questioning the order dated 12.06.2025 (Annexure P-2). The petitioner has also referred to the earlier order passed by this Court in WPS No. 4475 of 2026 on 04.06.2026, whereby the respondents were
directed to consider and decide the petitioner's representation within a further period of 45 days from the date of receipt of a copy of the said order.
2. Learned counsel for the petitioner submits that despite the aforesaid direction issued by the Coordinate Bench, no decision has yet been taken by the competent authority. It is submitted that the District Education Officer has addressed a communication dated 21.07.2026 to the Director, Public Instructions (DPI), stating that the Collector has expressed his inability to consider the petitioner's case on the ground that the process of rationalization has already been concluded and, therefore, no action can be taken at this stage. It is further submitted that the DPI be directed to take an appropriate decision on the said communication. Alternatively, it is prayed that the present petition be disposed of with a direction to the Collector to decide the petitioner's representation in terms of the
order passed by this Court in WPS No. 4475 of 2026.
3. Per contra, learned State counsel submits that if the petitioner submits a fresh representation before the Collector within ten (10) days, the same shall be considered and decided by the Collector,
3 subject to the rationalization process still being in operation and in accordance with law.
4. I have heard learned counsel for the parties and perused the material available on record.

Having regard to the submissions advanced by learned counsel for the parties, without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction that the petitioner shall submit a fresh representation before the Collector within ten (10) days from the date of receipt of a copy of this order. In the event such representation is submitted within the stipulated period, the Collector shall consider and decide the same, keeping in view the order dated 04.06.2026 passed in WPS No. 4475 of 2026, by passing a reasoned and speaking
order, in accordance with law, within a further period of twenty- five (25) days from the date of receipt of such representation.
6. With the aforesaid observations and directions, the present writ petition stands disposed of. Sd/-
