Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than four months. Complaint has already been submitted before the jurisdictional Court and the recovery in the present case is 3976 gms. of Ganja. Learned advocate appearing for the Air Customs Authority opposes the prayer for bail. I have taken into account the nature of the case as seizure was carried out at the Kolkata Airport. Having considered the judgment of the Hon’ble Apex Court in Barnali Bag versus Union of India (Special Leave Petition (Crl.) No. 3641 of 2026, I am of the opinion that the petitioner is entitled to the same benefit wherein the emphasis was on intermediate quantity.

Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 8th Court, Barasat, North 24 parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District North 24 Parganas without the prior permission of the learned Special Court. Additionally, the petitioner will make herself available to the Investigating Officer as and when required or any Officer assigned by the Principal Commissioner, Air Customs. The petitioner shall furnish her address where she would be residing prior to release from the learned jurisdictional Court. Accordingly, CRM (NDPS) 1472 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
