Affidavit of Service filed on behalf of the CESC Limited be kept with the records. The matter had appeared on 16.07.2026 and 22.07.2026 respectively when the appellant was not represented. It appears from the Affidavit of Service that despite service the appellant repeatedly chooses to be unrepresented. On behalf of the CESC Limited, it is submitted that there are serious allegations of theft and pilferage by the appellant and there are outstanding dues in excess of Rs. 1,77,767/-. In view of the repeated non-appearance of the appellant, FMA 1024 of 2021 along with the connected application being CAN 1 of 2019 (Old No: CAN 12525 of 2019) stands dismissed for default.
2 Liberty is granted to the CESC Limited to take necessary steps in accordance with law.
