IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE NATIONAL COMPANY LAW TRIBUNAL, BENGALURU BENCH TO DISPOSE OF PROCEEDINGS IN C.P.(IB) NO. 160/BB/2023 (ANNX-A) EXPEDITIOUSLY BUT NO LATER THAN 30 (THIRTY) DAYS FROM THE DISPOSAL OF THE PRESENT PETITION, AND IN ACCORDANCE WITH LAW APPLICABLE TO PROCEEDINGS UNDER SECTION 7 OF THE INSOLVENCY AND BANKRUPTCY CODE 2016 AND ETC., THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Sri Arvind Kamath, learned Additional Solicitor General of India is directed to accept notice for respondent No.1. 2. Notice to respondent No.2 is dispensed with in view of the proposed order to be passed. 3. The petitioner is before this Court seeking for the following reliefs: a) Direct the National Company Law Tribunal, Bengaluru Bench to dispose of proceedings in C.P. (IB) No. 160/BB/2023 (Annexure A) expeditiously but no later than 30 (thirty) days from the disposal of the present Petition, and in accordance with law applicable to proceedings under Section 7 of the Insolvency & Bankruptcy Code, 2016; b) Pass such other order(s) as this Hon'ble Court may deem fit in the interest of justice and equity. - 3 - HC-KAR CNR: KAHC010482842026 NC: 2026:KHC:37171 WP No. 21951 of 2026 4. The short grievance of the petitioner is that an application under Section 7 of the Insolvency and Bankruptcy Code, 2016 filed by the petitioner in CP(IB).No.160/BB/2023 at Annexure-A has been pending from the year 2023. 5. Though learned counsel for the petitioner fairly submits that it is not on account of any delay on the part of respondent No.1, but it is on account of various applications filed by the erstwhile promoters. 6. Be that as it may, an application filed under Section 7 has been pending for more than 3 years. It is therefore required that the said application be disposed of at the earliest, considering that the proceedings under the IBC are time sensitive. Directing respondent No.1 to dispose of the said proceedings as expeditiously as possible, petition stands disposed. Sd/- (SURAJ GOVINDARAJ) JUDGE KTY List No.: 1 Sl No.: 44
