Petitioner has filed this petition under Article 226 of the Constitution of India with following reliefs: “Reliefs Sought: 10.1. That, this Hon'ble Court may kindly be pleased to set aside and quash the impugned result of March 2023, Bachelor of Dental Surgery, issued in the name and Roll Number of the petitioner. 10.2. That, the Respondents may kindly be directed by the Hon'ble Court to conduct re examination for back log subject orthodontics, with relation to petitioner 10.3. That, any other relief, which this Hon'ble Court may deemed just and fit in facts and circumstances of the case.” 2. Petitioner has preferred the present petition, inter alia, stating that he is a student of Bachelor of Dental Surgery (Final Year) studying at Triveni Institute of Dental Sciences, Hospital and Research Centre, Bodri, Bilaspur, District Bilaspur (Chhattisgarh), which is affiliated to Pandit Deendayal Upadhyay Memorial Health Sciences and Ayush University of Raipur, District Raipur, Chhattisgarh. It is further stated that upon declaration of the petitioner’s result, he was not shown as having failed in the subject of Orthodontics. However, after the petitioner had appeared in the theory examinations of his other backlog subjects, he was subsequently informed that he had also been failed in the subject of Orthodontics. By the time, the petitioner 3 was apprised of the said fact, the opportunity available to him to appear in the backlog examination in the subject of Orthodontics had already elapsed, thereby depriving him of his legitimate opportunity to appear in the said examination. Being aggrieved by the aforesaid action and the resultant denial of an opportunity to appear in the backlog examination in the subject of Orthodontics, the petitioner has been constrained to approach this Court seeking above reliefs. 3. Learned counsel for the respondent/University submits that this writ petition has become infructuous as subsequently the petitioner has appeared in the examination and result has also been declared in favour of the petitioner. 4. None appeared on behalf of the petitioner to controvert the submission made on behalf of the respondent-University or to otherwise substantiate and prosecute the present petition. 5.
