Learned advocate for the petitioner submits that there has been change of circumstances. Mr. Krishnendu Bhattachrya, learned APP, appears for the State along with a junior of his choice as per the direction of this Court. The appointment of both Mr. Bhattacharya and the junior of his choice, if any, be regularized by the concerned authority. State has submitted a report wherein the statement of the complainant is enclosed. The statement reflects that both the petitioner and the complainant have mutually decided to continue their life.
2 Having considered the change of circumstances, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Sujit Kumar Shaw] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Accordingly, CRM (A) 1258 of 2026 is disposed of. Report submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
