1. By the present writ petition, the petitioner is seeking a direction to respondent No.3 to reconsider and decide the case of the petitioner in accordance with law pursuant to the request made by respondent No.2–Director regarding grant of increment to the petitioner. 2 authority to reconsider the case of the petitioner. However, the matter is still pending. He, therefore, prays that the petition may be disposed of with a direction to respondent No.3–Joint Director to consider and decide the application/representation of the petitioner, particularly Annexure P-4 dated 24.06.2024, in accordance with law.

Learned State counsel, on instructions, submits that respondent No.3–Joint Director shall consider the case of the petitioner in accordance with the applicable rules and law with regard to grant of increment upon his promotion from Class-III to Class-II and shall take an appropriate decision within a period of 60 days.
3. I have heard learned counsel for the parties and perused the material available on record.
4. Having regard to the facts and circumstances of the case and the submission made by learned State counsel on instructions, this Court is of the considered view that the grievance of the petitioner can appropriately be redressed by directing the competent authority
to
consider
and
decide
the
pending application/representation of the petitioner.
5. Accordingly, the writ petition is disposed of with a direction to respondent No.3–Joint Director to consider and decide the application/representation of the petitioner, including Annexure P- 4 dated 24.06.2024, with regard to grant of increment upon his promotion from Class-III to Class-II, strictly in accordance with the applicable rules and law, by passing a reasoned and speaking

order, within a period of 60 days from the date of receipt of a copy of this order.
6. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner, and the competent authority shall take an independent decision in accordance with law.
7. With the aforesaid direction, the writ petition stands disposed of. Sd/-
