3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 15343 of 2026 The Court made the following Order: Instant Writ Petition has been filed by the petitioner under Article 226 of the Constitution of India for the following relief:
“.... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 3 to 8 threaten the petitioner to hand over the house (i.e.. West side main door) in front of car parking site (i.e., 22 Sy. Feet) situating in R/o. H. No. 2-10, Kakanur Village, Bandi Atmakur Mandal, Nandyal District (pervious Kurnool District) to the 9th respondent and pressuring the petitioner to handover the subject house in front of car parking site to the 9th respondent as illegal, arbitrary, one without jurisdiction and violation of Article 21 of Constitution of India and consequently direct the respondents nos.3 to 8 not to interfere in the civil disputes between the Petitioner and the 9th respondent by pressuring the petitioner to hand over the house (i.e., West side main door) in front of car parking site (i.e., 22 Sy. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for the respondents. 3.
Learned Assistant Government Pleader for Home basing on the Written Instructions dated 14.06.2026 of the Sub-Inspector of Police, Bandi Atmakur Police Station submits that the
4 concerned Mandal Executive Magistrate initiated proceedings under Section 126 of the Bharatiya Nagaik Suraksha Sanhita, 2023, against the petitioner and unofficial respondent No.9 vide MC.No.21 of 2026 dated 09.03.2026. He furnished a copy of said proceedings before this Court and served the same on learned counsel for the petitioner. 4. At that juncture, learned counsel for the petitioner, seeks permission of this Court to withdraw the instant Writ Petition granting liberty to the petitioner to file fresh Writ Petition challenging the said proceedings, in the manner known to the law. 5. Permission is accorded. 6. Accordingly, this Criminal Petition is dismissed as withdrawn granting liberty to the petitioner to file fresh Writ Petition in the manner known to the law.
