1. In terms of order passed on this writ petition on 10th June, 2026, Mr. Das, learned Additional Government Pleader representing the State respondents has filed a communication dated 13th July, 2026 of Officer-in- Charge, Tiljala Police Station and same is taken on record. Copy of the communication dated 13th July, 2026 is made over to the learned advocate representing the petitioner.
2. It is disclosed in the communication dated 13th July, 2026 that investigation is being carried out in Tiljala Police Station Case No.192 dated 17th May, 2024.
3. If petitioner is aggrieved by inaction on the part of the concerned police authorities in completing investigation of aforesaid case, in that event petitioner is required to approach jurisdictional Magistrate under Section 175(3) of BNSS, 2023.
4. In this regard, reliance is placed on the judgment of the
2 Hon’ble Supreme Court reported in 2026 SCC Online SC 798 (Sujal Vishwas Attavar & Anr. v. State of Maharashtra & Ors.)
5. It is succinctly decided in paragraph 7 of Sujal Vishwas Attavar (supra) that after registering FIR if parties are not satisfied with steps taken by the concerned police authorities, in that event approach has to be made within statutory framework.
6. Hence, present writ petition is not entertained and same stands dismissed.
7. However, this order shall not preclude the petitioner to approach appropriate forum in pursuit of remedy.
8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
