Writ petition is heard in presence of the learned advocates representing petitioner and respondents. 2. On perusal of the writ petition it appears mandamus is sought for directing the concerned police authorities to take certain steps for expediting investigation and bring the same to logical conclusion. 3. Mr. Suryaneel Das, learned advocate representing State respondents submits that an FIR was registered being Jadavpur Police Station Case No. 184 of 2025 dated 16th December, 2025 and investigation is going on. Notice has been issued to Meta. 4. In support of such contention communication dated 8th July, 2026 of Officer-in-Charge, 2 Jadavpur Police Station is filed today and same is taken on record. Copy of the communication dated 8th July, 2026 is made over to the learned advocate representing petitioner. 5. From the case made out in this writ petition it appears that petitioner is not satisfied with the steps taken by the investigating agency while investigating aforesaid criminal prosecution. It is decided by the Hon’ble Supreme Court in the judgment reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar and Anr. Vs. State of Maharashtra and Ors.) that if party is dissatisfied with the investigation being carried out by the investigating agency after registration of FIR in that event approach needs to be made within the statutory framework. Therefore, petitioner needs to approach jurisdictional Magistrate under Section 175(3) BNSS in the event petitioner is dissatisfied with the investigation being carried out. 6. In view of availability of alternative remedy under Section 175(3) BNSS, 2023 present writ petition is not interfered with and same stands dismissed. 3 7. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy. 8.
