The instant writ petition has been filed, inter alia, complaining unauthorized and illegal construction at holding no. 229 GT Road, Shibpur, Ward no. 34, Howrah – 711102. 2. The writ petition would disclose three representations and three several reminders issued to the municipality. The reminders are issued in the name of North CacluttaJanhit Sankalp (NGO). 3. Learned advocate appearing for the petitioner would seek to withdraw the writ petition. No reasons have been assigned for the withdrawal. 4. The municipality is represented. 5. Ms. Sinha learned advocate appearing for the municipality, however, could not enlighten this Court as to whether the complaint filed has been redressed or not. 6. Noting that the matter pertains to illegal construction, this Court refuses to permit withdrawal of the writ petition. This Court accordingly directs the municipality to carry out an inspection at the locale and prepare a report. 7. It is made clear that if the municipality is of the view that any illegal construction has been carried out, 2 appropriate steps in accordance with the provisions of Section 177 of the Howrah Municipal Act, 1980 shall be initiated. If, however, no illegal construction is noted, the matter shall not be proceeded further. 8. It is expected that a decision in this regard shall be taken as expeditiously as possible within a period of four weeks from date. 9. Accordingly, the writ petition is disposed of. 10. The report shall, however, filed by the municipality before the Learned Registrar General of this Court. Once, such report is filed, the same shall be attached with the file 11.
