G.P. for Registration and Stamps The Court made the following: 2 BSB,J W.P.No.14202 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondents, particularly the respondent No. 2, in failing to dispose of the appeal file No. 23/2026 dated 30.12.2025 filed by the writ petitioner under the Andhra Pradesh Societies Registration Act, 2001, challenging the order passed by the respondent No. 3 on 18.11.2025 vide Application No. SCR012500110- 410 rejecting registration of a society named “Gold, Silver and Diamond Merchants Association” as highly illegal, arbitrary and consequently to direct the respondents to receive the registration deed and register the same without any objection. 2. The case of the petitioner is, stated briefly, as follows: a. The petitioner is an association intended to streamline the business activities of several gold shops in Gandhi Road, Ongole, as the prospective business people made proposal to form a society in the name and style of “Gold, Silver and Diamond Merchants Association”. Koppuravuri Hari Prasad was proposed as president and an application under the Andhra Pradesh Societies Registration Act, 2001 was submitted to the respondent No. 3 on 15.11.2025. There was no society with the similar name as the previous society with the same name formed in the year 1969 and is not in existence and carrying out any activity. No annual general body meeting of it conveyed nor was its accounts maintained. b. Therefore, a fresh registration with the above said name was proposed. However, the respondent No. 3, without verifying whether the said society is in existence, mechanically rejected the application on 18.11.2025 stating that a society with the same name exists. Aggrieved by the rejection order, an appeal was filed vide file No. 23/2026 before 3 BSB,J W.P.No.14202 of 2026 the respondent No. 2 on 30.12.2025. It is still pending, without any reason or objection. Hence, this writ petition was filed. 3. Sri G. Divyatheja, learned Assistant Government Pleader for Registration and Stamps, submitted that written instructions have not yet been received. 4. The learned counsel for the petitioner submitted that since sufficient time had been taken by the respondent No. 2 for disposing of petitioner’s appeal, the writ petition may be disposed of with appropriate directions. 5. In reply, the learned Assistant Government Pleader for Registration and Stamps requested to dispose of the writ petition giving sufficient time to the respondent No. 2 for disposing the petitioner’s appeal. 6. In view of the above submissions, the writ petition is disposed of directing the respondent No. 2 to dispose of the petitioner’s appeal vide file No. 23/2026, dated 30.12.2025 within a period of six (06) weeks from the date of receipt of copy of this order, if not disposed of.
