The present writ petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate writ or order in the nature of certiorari for quashing the impugned action of respondents of calculating the amount of 150 days (Rs.10,48,280/-) instead of 228 days (Rs.15,93,386/-). Further for quashing impugned action dated 16.09.2025 whereby withholding the amount of Rs.4,76,001/- on account of recovery (excess payment due to merger of Ph.D increments in the basic pay w.e.f. March, 2008 to March, 2020). Further praying for issuance of a writ in the nature of mandamus directing respondents to release amount of PUNEET CHAWLA 2026.07.15 14:54 I attest to the accuracy and integrity of this document 2 CWP-16753-2026 Rs.10,21,107/- to petitioner with interest @ 12% p.a. from the due date till its realization. 2. Learned counsel for the petitioner, at this stage, submits that he would be satisfied if a direction is issued to respondent No.1/competent authority to consider and decide the request letter dated 05.01.2026 (Annexure P-6) by passing a reasoned and speaking order within a time- bound period. 3. Learned counsel for respondent No.1-University submits that he has no objection in the event a direction is issued to respondent No.1/competent authority to consider and decide the request letter dated 05.01.2026 (Annexure P-6) by passing a reasoned and speaking order within a stipulated period. 4. In view of the limited prayer made by counsel for the petitioner without commenting upon the merits of the case, the present petition is disposed of and the respondent No.1/competent authority is directed to hear and decide the request letter dated 05.01.2026 (Annexure P-6) by passing a speaking order in a time bound manner within a period of three months from the date of receiving a certified copy of this order. Further the decision taken thereof shall be conveyed to the petitioner. 5. Needless to say, if the petitioner is found entitled to the relief sought, the same be granted forthwith by respondent/competent authority. Considering that the petitioner's request/representation is yet to be decided, it is directed that, till a final decision is taken thereon, any proposed recovery from the petitioner shall remain in abeyance. 7. It is made clear that any wilful deviation or non-compliance of the directions issued by this Court shall entail consequences under Article 215 of the Constitution of India and it shall be open to the petitioner to seek initiation of appropriate contempt proceedings in accordance with law. 8.
