ORAL ORDER
1. The challenge in the present petition is to an Order passed by the learned Principal Civil Judge (Jr.Dn.) and JMFC, Gauribidanur, Chikkaballapur dated 18.12.2021 [hereinafter referred to as the “Impugned Order”], whereby an application, seeking compromise of the matter inter se the parties was decided. The challenge is also to

3 an Order dated 15.04.2025 passed by the learned Trial Court, rectifying the clerical error in the compromise decree.
2. The grievance of the petitioner is that the petitioner who was respondent No.4 in the FDP bearing No.7/2016 in O.S.No.307/2012 and was also arraigned as respondent No.4 to the plaint, was not a party to the compromise petition.
3. The learned counsel for the respondents fairly submits that the name of the petitioner (Smt. Mahadevamma), who was respondent No.4 in the plaint was inadvertently left out from the compromise petition. He submits that the matter may be remanded to the learned Trial Court to enable further proceedings including a fresh application for compromise.
4. The learned counsel for the petitioner/respondent No.4 is agreeable to this suggestion.

5. Accordingly, given the consensus between the parties, this Court deems it apposite to pass the following:
ORDER (i) The Impugned Order(s) are set aside.
(ii) The parties are directed to appear before the learned Trial Court on 10.08.2026 for further proceedings including compromise, if any, between the parties.
(iii) This Order is passed without prejudice to the rights and contentions of the parties.
(iv) All pending application(s) shall stand closed.
