Learned advocate appearing for the petitioner submits that the petitioner is in custody for one year ten months. Learned advocate for the State opposes the prayer for bail. I have taken into account the facts of the case which had its genesis is in a dispute between the father and the son over the motor cycle. Having regard to the period of detention of the present petitioner and without entering into the merits of the case, I am inclined to grant bail to the petitioner. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned CJM, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District Nadia without the prior permission of the learned Court. Accordingly, CRM (M) 1578 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
