Learned senior advocate appearing for the petitioner submits that there has been recovery of 1.343 kgs. of Brown Sugar from another accused and the present petitioner has been implicated on the basis of statement of co-accused and he is in custody for more than five months. It has been submitted that charge-sheet has already been submitted before the jurisdictional court and as such, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that for a period of four months prior to the incident, there were 93 calls between the petitioner and the principal accused from whom seizure has been effected. So far as the present
2 petitioner is concerned, there has been no recovery from him. I have taken into account the report along with Memo of Evidence submitted by the State which do not specify any previous antecedents of the present petitioner in respect of cases relating to NDPS Act. Having considered the overall circumstances of the case, the period of detention of the present petitioner and the fact that prosecution has relied upon nine witnesses in support of its case which will consume some time, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Ashidul Sk @ Asidul Sk @ Rahul shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 4th Court, Malda.
If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. Report along with Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 871 of 2026, is, thus, disposed of. 3 All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
