29/07/2026 D/L – 63 Court No.35 S. Kundu Allowed C.R.M.(NDPS) 1454 of 2026 In Re: An application for bail under Section 483 of the BNSS, 2023. In connection with Swarupnagar P.S Case no. 19 of 2024 dated 15/01/2024 under Sections 21(c) of the NDPS Act. In the matter of: Rafikul Molla …Petitioner. Ms. Malashree Ghosh …for the petitioner. Mr. Shataroop Purkayashtha …for the State. Learned advocate appearing for the petitioner submits that the seizure in the present case is 100 bottles and the petitioner is in custody for two years six months. Learned advocate appearing for the State does not dispute the quantum of seizure in the present case and the period of detention. Having regard to the overall circumstances, I am inclined to release the petitioner on bail as the trial would take some more time to be taken to its logical conclusion. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 6th Court, Barasat, North 24 parganas. 2 If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District North 24 Parganas without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1454 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
