The validity of the impugned orders passed in the year 2009 and 2011 are under challenge before this Court by way of filing the instant petition filed by the petitioner in the year 2013. The FIR lodged by the petitioner resulted in the Final Report (Negative) and thereafter the Protest Petition was submitted against the same however, the learned Magistrate vide order dated 03.10.2009 accepted the Final Report (Negative) and rejected the Protest Petition of the petitioner against which a Revision Petition was submitted. However, the same was also rejected vide order dated 19.05.2011. 2. Learned counsel for the petitioner submits that at the relevant time, the age of the petitioner was 65 years at the time [2026:RJ-JP:16994] (2 of 2) [CRLMP-1851/2013] of lodging of the FIR and he is not in touch with the petitioner since last 13 years. Hence, he is not having any instructions, so appropriate orders be passed. 3. Considering the aforesaid, this Court deems it just and proper to dismiss the instant petition for want of prosecution, while granting liberty to the petitioner to move an application for revival of the instant petition. In case, any cause of action/grievance still survives with the him. 4. With the aforesaid observation and direction, the instant petition stands dismissed.
