Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 80 days. The subject matter of the case relates to that 1,200 gms of Heroin. Some of the other persons have been granted bail. Total number of witnesses cited by the prosecution in the charge sheet is 16 and till date, out of which 3 have been examined. Learned advocate appearing for the State was confronted regarding the complicity of the present petitioner to which the learned advocate replied that the petitioner is the supplier. So far as the materials which are appearing in the case diary, the same relates to co-accused and whatsapp message. No digital materials were sent for being verified before the appropriate authority.

Having regard to the nature of evidence available against the petitioner, I am of the opinion that further detention of the petitioner is unwarranted. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1478 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
