This revisional application has been filed seeking a direction for the expeditious disposal of Complaint Case No. 172 of 2024, instituted under Sections 127, 118, 109, 303, 318, 351, 352, 324 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, which is presently pending before the Learned Judicial Magistrate at Baruipur, South 24 Parganas. The petitioner is the complainant in the said case. Learned Advocate appearing for the petitioner submits that the complaint case has remained pending before the Learned Magistrate for more than three years. It appears from the records that the matter was last taken up on 5 January 2026, when accused no.1 surrendered before the Learned Magistrate. The Learned Magistrate, however, fixed 26 November 2026 for receiving the service return in respect of accused nos. 2, 3 and 4. Having regard to the aforesaid facts and circumstances, this revisional application is disposed of with a direction to the Learned Magistrate to proceed with the complaint case expeditiously and without granting any unnecessary adjournment to either of the parties. In the event accused nos. 2, 3 and 4 fail to appear before the
2 Learned Magistrate despite due service of process, the Learned Magistrate shall be at liberty to take appropriate steps in accordance with law to secure their presence, including, if warranted, by issuing bailable or non-bailable warrants of arrest. Accordingly, CRR 5575 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
