The petitioner has filed this petition seeking for the following relief(s):- ABHIGYA SAXENA Digitally signed by ABHIGYA SAXENA 2 “10.1 That, the Hon'ble Court may kindly be pleased to call the entire records relating to the case of the Petitioner. 10.2 That, the Hon'ble Court may kindly be pleased to issue a Writ in the nature of mandamus directing the respondents to take appropriate action in compliance of order dated-02.07.2026 passed by the respondent no.1 and letter dated- 04.08.2026, and further direct to hand over the Fair Price Shop, Majhgawan, to the petitioner for its operation, running and ration distribution, within a period of 07 days. 10.3 Any other relief which Hon'ble Court deems fit and proper in the facts and circumstances of the case and cost of the petition.” 2. Learned counsel for the petitioner submits that, on the basis of a complaint made against the petitioner, respondent No.2 cancelled the allotment of the fair price shop to the petitioner vide order dated 26.09.2025. Aggrieved by the said order, the petitioner preferred an appeal before respondent No.1, which was allowed and the order dated 26.09.2025 passed by respondent No.2 was set aside. Thereafter, the petitioner approached the concerned authority vide letter dated 04.08.2026 seeking handing over of the charge of the restored fair price shop. The SDO (Revenue) also directed respondent Nos.3 and 4 to take necessary action in compliance with the order passed by the Additional Collector; 3 however, no action has been taken by the respondent authorities till date. Hence, the petitioner has filed the present petition seeking the limited relief of directing the concerned respondent authority to comply with the order dated 02.07.2026 passed by the Additional Collector, Baikunthpur, District Koriya, and to hand over the restored fair price shop to the petitioner. 3. Learned State counsel has no objection to the limited prayer made by the petitioner. 4. I have heard learned counsel for the parties and perused the records with utmost circumspection. 5. Considering the facts and circumstances of the case, the present petition is disposed of with a direction to respondent Nos.3 and 4 to comply with the order dated 02.07.2026 passed by the Additional Collector, Baikunthpur, District Koriya, and to take all necessary consequential steps for handing over the charge of the restored fair price shop to the petitioner within a period of 10 days from today. It is made clear that this Court has not expressed any opinion on the merits of the case, and the respondent authorities shall act strictly in accordance with law to comply the same. 6.
