That, this Hon'ble Court may kindly be pleased to call for the entire records concerning the present case for its kind perusal. 10.2. That, this Hon'ble Court may kindly be pleased to issue an appropriate writ quashing and setting aside the impugned Supplementary award / order dated 09.06.2021 and 12.11.2025 Annexure P-1& P-2. 10.3. That, this Hon'ble Court may kindly be pleased to Issue an appropriate nature of Writ to Respondent no. 1& Respondent no. 2& Respondent no. 3 to compensate the AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.08.20 11:51:15 +0530 2 Petitioner with 18% of interest on the total amount of Compensation for the Land Acquired and Assets on the Land Acquired from the date of initial Publication for the Acquisition till the date when the amount is Availed. 10.4. That, this Hon'ble Court may kindly be pleased to Issue an appropriate nature of Writ to Respondent no. 3&Respondent no. 1 to reassess the Value of the Acquired Land property & Assets on the Acquired Land Property of the Petitioner as Acquired Land Property is within 20 meters from & adjoining the Main Road / National Highway. 10.5. That, this Hon'ble Court may kindly be pleased to Issue an appropriate nature of Writ to Respondent no. 3&Respondent no. 1 to evaluate the Acquired Land Property of Petitioner to the ongoing market value Which is 10,000,000/- Per Acre adding Multiplying factor of 2 to the value of the Land and adding 100 % Solatium on the Value arrived of the Land. 10.6. That, this Hon'ble Court may kindly be pleased to Issue an appropriate nature of Writ to Respondent no. 3&Respondent no. 1 to evaluate the Assets on the Acquired Land Property of Petitioner to the ongoing market value Which is 2,43,000/-adding 100% Solatium& interest on the Value arrived. 10.7. That, this Hon'ble Court may kindly be pleased to issue an appropriate nature of writ to Respondent no. 1&Respondent no. 2 & Respondent no. 3 to compensate the Petitioner with an interest of 15% on the amount of Compensation for the Acquired Land and Trees (Assets) on Acquired Land as per the provision of sec. 80 of The Land Acquisition Act, 2013. 10.8. This Hon'ble Court may Kindly allow the Petitioner to take recourse and approach appropriate Bench, Court, Forum and take recourse to such remedies as may be available to them under law, of the provisions governing the same. 10.9. This Hon'ble Court may kindly be pleased to Issue an appropriate nature of Writ to Respondent no. 1 &Respondent no. 2&Respondent no. 3 to not take any retaliatory action against the Acquisition & Compensation to the Petitioner. 10.10. Any other relief(s) / orders / writ in favour of the Petitioner as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present Writ Petition. 3 2. Learned counsel appearing for the respondent-NHAI at the outset submits that the petitioner has an efficacious alternative remedy available under Section 3G(5) of the National Highways Act, 1956. 3. Learned counsel appearing for the petitioner submits that, in view of the availability of an alternative remedy under Section 3G(5) of the National Highways Act, 1956, the petitioner may be permitted to avail the said remedy in accordance with law. 4. In view of the submissions made by learned counsel for the parties, the present writ petition is disposed of with liberty to the petitioner to avail the alternative remedy available to him under Section 3G(5) of the National Highways Act, 1956, in accordance with law. 5. It is made clear that this Court has not expressed any opinion on the merits of the case. In the event the petitioner avails the aforesaid remedy, the competent authority shall consider and decide the matter strictly in accordance with law. 6.
