Das, learned counsel for the applicant. Also heard Mr. A. Sarma, learned standing counsel, OIL as well as Mr. D.J. Das, learned CGC appearing for the Railway authorities. The applicant who is presently working as a Appr. JE/ Works with the N.F. Railways had submitted his candidature for the post bearing Code No. C1V12025, in pursuance to an advertisement dated 18-07-2025 issued by the OIL Authorities. On conclusion of the selection process, a provisional select list came to be published, wherein, the name of the applicant figured. The OIL authorities published a list of shortlisted candidates and therein, the petitioner was placed at Sl. No. 3 in order of merit, for document verification. Page No.# 3/5 One of the documents required to be produced is a No Objection Certificate (NOC) from his employer, i.e. N.R. Railways. Although, the petitioner prior to applying in pursuance to the said advertisement dated 18-07-2025, had approached the Railway authorities for issuance of the NOC, however, the matter was kept pending, leading to institution of the connected writ petition, being W.P.(C) No. 309/2026. This Court vide order dated 22-01-2026 passed in W.P.(C) No. 309/2026, had directed the Railway authorities to consider and dispose of the application filed by the applicant, herein, for grant of NOC It is submitted by Mr. Das that the Railway authorities have now taken a decision to reject the prayer of the petitioner for issuance of NOC in the matter. Mr. Das submits that the said rejection of his prayer for grant of NOC being permissible to be challenged only before the Guwahati Bench of the Central Administrative Tribunal (CAT), the applicant has instituted appropriate proceeding before the Tribunal. Mr. Das submits that it is in the said background that the applicant has instituted the present interlocutory application praying for cancellation of the prayer Nos. (B) and (C) in the connected writ petition being W.P.(C) No. 309/2026. Mr. A. Sarma, learned standing counsel, OIL and Mr. D.J. Das, learned CGC appearing for the Railway authorities have submitted that the prayers made by the petitioner in the connected writ petition, qua the Railways would only be permissible to be so made before the CAT, Guwahati Bench, in an appropriate proceeding at the first Page No.# 4/5 instance. I have heard the learned counsel for the parties and have also perused the materials available on record. On considering the projection made by the applicant in the present application and also the fact that the prayer Nos. (B) and (C) would not be permissible to be considered by a Single Bench of this Court at the first instance; the petitioner having already approached Central Administrative Tribunal by way of instituting appropriate proceeding seeking relief(s), which would be covered by prayer (B) and (C) made in the connected writ petition, this Court is of the view that the said prayers would be required to be deleted from the relief column of the connected writ petition. Accordingly, the prayer (B) and (C) made in the connected writ petition being W.P. (C) No. 309/2026 stands deleted. The said issue would now be required to be adjudicated by the Central Administrative Tribunal, Guwahati Bench, on its own merit. The prayer (D) made in the original writ petition would now be numbered as prayer No. (B). Petitioner to file an amended writ petition, incorporating the correction made in the relief portion of the connected writ petition being W.P.(C) No. 309/2026.
