28-07-2026 Item No.63 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side WPA No.25538 of 2023 Sayan Mondal -vs- The State of West Bengal & Ors. Mr. Pradip Saren Mr. Soumik Ghosh Ms. Saheli Hembrom …for the petitioner Ms. Mary Datta Ms. Sneha Chatterjee …for the State Mr. Santanu Kumar Mitra Mr. Amartya Pal …for the Council 1. The petitioner appeared in the Higher Secondary Examination in the year 2023. Being dissatisfied with the marks awarded to him, he applied for re- evaluation of the marks. The answer scripts of the petitioner were verified and two marks were increased. The petitioner is still dissatisfied. 2. Prayer has been made to re-evaluate the answer scripts all over again. 3. Learned counsel for the West Bengal Council of Higher Secondary Education relies upon an order passed by this Court on December 4, 2025 in WPA No.25322 of 2025 (Adrija Bhattacharjee v. State of West Bengal & Ors.) and submits that the law relating to the post-publication scrutiny does not permit further reassessment or re-evaluation of marks, once the same has already been allowed. Prayer has been made to dismiss the writ petition. 4. Upon hearing the respective submissions made on behalf of both the parties, it appears that the prayer of the petitioner for scrutiny was then allowed and two marks were increased. There is no scope for further reassessment or re- evaluation of the answer scripts of the petitioner. 5. In view of the above, no relief can be granted to the petitioner. The writ petition fails and is hereby dismissed. 6. All parties are to act on the server copy of this order duly downloaded from the official website of this Court. 7. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2 3
