1. On perusing writ petition and the prayer couched therein, it appears that petitioner is dissatisfied with steps taken by the concerned police authorities in Park Street Police Station Case No.45/2026 dated 24th February, 2026.
2. According to the petitioner, certain steps are required to be taken by the investigating agency for taking forward the investigation to its logical conclusion.
3. If petitioner is dissatisfied with steps taken by the investigating agency or petitioner finds that inaction on the part of the concerned police authorities in investigating the case, in that event approach has to be made to jurisdictional Magistrate under Section 175(3) of BNSS, 2023.
4. In this regard, reliance is placed on the judgment of the Hon’ble Supreme Court reported in 2026 SCC Online SC 798 (Sujal Vishwas Attavar & Anr. v. State of Maharashtra & Ors.)
5. It is succinctly decided in paragraph 7 of Sujal
2 Vishwas Attavar (supra) that after registering FIR if parties are not satisfied with steps taken by the concerned police authorities, in that event approach has to be made within statutory framework.
6. Hence, present writ petition is not entertained and same stands dismissed.
7. However, this order shall not preclude the petitioner to approach appropriate forum in pursuit of remedy.
8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
