The present intra-Court Appeal is directed against the order dated 02.01.2026, passed by the learned Single Judge in Writ Petition (M/S) No. 3744/2025, by which, while entertaining the Writ Petition filed by the appellant, challenging an order dated 23.12.2025 passed by respondent no. 2, the Court granted four weeks’ and no more time to the State to file counter affidavit, and thereafter the Interim Relief Application would be considered. The next date fixed was
10.02.2026. On 10.02.2026, an order was passed to list the Writ Petition before appropriate Bench, as the learned Single Judge was of the opinion that the Writ Petition would be maintainable only under Article 226 of the Constitution of 1

India. Thereafter, the matter has not been listed before any Court.

Learned counsel for the appellant submits that the matter is extremely urgent, and since no date has been fixed in the Writ Petition, the appellant is suffering.

The order of learned Single Judge merely defers the hearing of the Interim Relief Application to another date, and no right of any party has been decided. Therefore, the present intra-Court Appeal would not be maintainable. It is, accordingly, dismissed. However, we direct the Office to list the Writ Petition before appropriate Bench on 19.02.2026

All pending applications stand
disposed of accordingly.
