SAKTIPADA MUKHERJEE Vs.
THE STATE OF WEST BENGAL & ORS.
Ms. Bratati Dutta, Advocate …...for the Petitioner Mr. Manoj Kumar Mondal, Advocate ……for the State
1. Affidavit of service, as filed, be kept with the record.
2. The petitioner was an Instructor in Shorthand & Typewriting (English) in a Commercial Institute run by Ramkrishna Mission Ashram, Narendrapur, Kolkata, a Government aided institution under the mass education, Extension and Library Services Department.
3. Upon attaining the age of superannuation, the petitioner retired from service on 30.04.2012. The petitioner has thereafter been granted the gratuity sometime on 11.08.2025. Clearly the petitioner was entitled to such payment, which is admitted by the authorities concerned by release of the payment.
4. It is also not in dispute that the payment was made at a belated stage, after almost 12 years.
5. The law is presently well-settled and for such purpose, the respondent nos. 3 and 4 are directed to calculate the interest component at the rate of 8% per annum from 01.05.2012 till 10.08.2025.
6. The respondent no. 4 will release the afore-stated payment upon calculated by the respondent no. 3 by
15.03.2026.
7. With these observations, WPA 24877 of 2025 is disposed of. No order as to costs.
