...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order, writ or direction more particularly in the nature of Writ of Mandamus by declaring action of the Respondent No. 2 to 4 were not taking action to remove the illegal/unauthorized shed construction of 9th respondent by encroaching panchayath land in front of the petitioner house vide Assessment 208513000500 (Old Assessment No. 535) situated at Yekollu Gram Panchayati, Doravarisatram Mandal, Tirupati District, which creating public nuisance, affecting traffic safety, pedestrian movement, and public infrastructure, thought the petitioner made representation dated 16.12.2025, as illegal, arbitrary and violative of Article 14, 21 of Constitution of India and also violative of AP Panchayat Raj Act and consequently direct the respondents No.2 to 4 to remove unauthorized shed construction of 6th respondent by encroaching Panchayati land d forthwith and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondent No. 5 to remove illegal/unauthorized shed construction of 6th Respondent by encroaching upon Panchayati land in front of the petitioner house vide Assessment No. 208513000500 ( Old Assessment No. 535) situated at Yekollu Gram Panchayati, Doravarisatram Mandal, Tirupati District forthwith by considering representation dated 16.12.2025, pending disposal of Writ Petition pending disposal of the above writ petition and pass such other order or orders may deem fit and proper in the circumstances of the case. ORDER
The above writ petition is filed to declare the action of respondents 2 to 4 in not taking action in removing the shed constructed by the 6th respondent in front of petitioner’s house by encroaching the Panchayat land, as illegal and arbitrary. 2. Sri Nagaraju Kollati, learned counsel for the petitioner would submit that pending the writ petition, the shed erected by the 6th respondent was removed by the respondent-authority by following due procedure. Hence, the cause in the writ petition does not survive for adjudication and the writ petition has now rendered infructuous. 3. Recording the said submission, the Writ Petition is Dismissed as Infructuous. No costs.
