Mr. Sagar Saha Mr. Saswata Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner has been falsely implicated in connection with the present case because of change in administration. Learned advocate appearing for the State opposes the prayer for anticipatory bail and emphasizes on the role of the present petitioner. I have taken into account the materials appearing against the petitioner including the fact that the accusations are of 20th November, 2025. Having considered the same, I am of the view that although, a case is made out but custodial detention of the present petitioner is unwarranted. As such, the prayer for anticipatory bail of the petitioner namely, Tapas Sarkar is allowed. 2 Accordingly, I direct that in the event of arrest, the petitioner shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As, the investigation of the case is still in progress, petitioner within a period of 10 days from date will meet the investigating officer of the case and thereafter make himself available as and when called for the by the investigating officer of the case. With the aforesaid observations, CRM (A) 1558 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
