28/07/2026 D/L – 299 Court No.35 S. Kundu
C.R.M.(M) 1577 of 2026
In Re: An application for bail under Section 483 of the BNSS, 2023. In connection with English Bazar P.S Case no. 1050 of 2025 dated 23/05/2025 under sections 137(2)/140(3)/3(5) of the BNS and adding Sections 140(1)/103(1) of the BNS and charge sheet under sections 140(1)/103(1)/238(a)/61(2)(a)/3(5) of the BNS. In the matter of: Moumita Hassan @ Moumita Hasan …Petitioner. Mr. Tapodip Gupta Mr. Suman Bhanja Ms. Usashi Chattopadhyay …for the petitioner. Mr. Rajendra Banerjee Mr. Amal Kr. Datta …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for about one year two months. Charges have already been framed by the learned trial Court. However, the witness action has not commenced. Learned advocate for the State refers to the relevant materials appearing in the case diary against the petitioner. Having regard to the totality of the circumstances, I am not inclined to grant bail to the petitioner at this stage. In spite of other accused being released on bail. The petitioner will renew her prayer for bail after the evidence of few of the relevant witnesses is over (at least five witnesses).

The learned trial court would ensure that at least in a month one witness is completed. Accordingly, CRM (M) 1577 of 2026 is dismissed at this stage. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
