Learned advocate appearing for the petitioner submits that the petitioner is in custody for three years nine months and till date 16 witnesses have been examined. The prosecution intends to examine 10 more witnesses in support of its case. Learned advocate for the State opposes the prayer for bail and submits that there were eye-witnesses. Prima facie from the facts it reflects that initially case was registered under section 307 of the IPC. Subsequently, section 302 of the IPC was added. Having considered the period of detention of the petitioner and further time which would be consumed to take the trial to its logical conclusion and without entering into the merits of the case, I am inclined to release the petitioner on bail.

As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned CJM, Alipore, South 24 parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District Kolkata Municipal Corporation without the prior permission of the learned Court. Accordingly, CRM (M) 1574 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
