1. Petitioner seeks anticipatory bail in FIR No. 41 dated 01.03.2026 under Sections 115, 126, 3(5), 351(3) Bharatiya Nyaya Sanhita, 2023, Police Station Nangal Chaudhri, District Mahendergarh. Offences under Sections 109 and 238 BNS were added in the FIR and Section 110 BNS was deleted from the FIR during investigation. This is the first petition for anticipatory bail.
2. On 04.06.2026, following order was passed:
“Learned counsel for the petitioner has inter alia argued that although the petitioner has been named in the FIR, yet, he has not been specifically attributed any injury detected on person of the injured; that although there is a medical opinion declaring all the three injuries collectively as dangerous to life, yet, it has not been mentioned as to how the injuries detected on person of the complainant-injured have been declared dangerous to life AJAY GOSWAMI 2026.07.15 11:08 I attest to the accuracy and integrity of this document
CRM-M-32794-2026 (O&M) -2- especially when the same are not on vital parts of the body of the injured; that the cause given in the medical opinion is a debatable cause to be determined during trial; that the petitioner is permanent resident of District Mahendergarh and there are no chances of his fleeing justice; that the case against the petitioner is distinguishable to the case against his two co-accused. Notice of motion. Mr. Sushil Bhardwaj, Addl.A.G., Haryana, accepts notice on behalf of the State of Haryana and prays for time to file a status report. At his request, adjourned to 14.07.2026 for the said purpose. However, without commenting anything upon merits of the FIR/matter in question but considering the
arguments of the learned counsel for the petitioner and the totality of the facts/circumstances of the present case, the petitioner is directed to join investigation with the concerned investigating officer within seven days from today. It is also ordered that in the event of his arrest in the FIR in question, he shall be released on interim bail to the satisfaction of such officer. However, on such bail, he shall comply with the term/s and condition/s contained in Section 480(3) and 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.”
3. Learned State counsel has filed status report and on instructions from PSI Harish submits that petitioner has joined investigation and is no longer required for custodial interrogation. Learned counsel for the complainant opposes the prayer for anticipatory bail.
